The EB-5 program allows foreign nationals to obtain U.S. permanent residence through a qualifying investment in the American economy. Applicants who meet the requirements may secure green cards not only for themselves, but also for their spouse and unmarried children under the age of 21.
Most applicants qualify by investing $800,000 USD into a project connected to a government-authorized Regional Center. These projects are often tied to commercial developments, infrastructure initiatives, or large-scale real estate ventures designed to create jobs in the United States.
After the investment is completed and the required petition is filed, applicants and their families may receive conditional permanent residence within approximately 2–3 years (or more). Two years after receiving conditional green cards, applicants must file an additional petition showing that the investment created jobs or generated economic benefits as required under the program. If approved, the conditions are removed and permanent resident status is maintained.

Applicants must submit Form I-526 to U.S. Citizenship and Immigration Services (USCIS). This petition must demonstrate:
- A qualifying investment of at least $800,000 USD
- Lawful source of funds
- Compliance with EB-5 program requirements
Step 3: Petition Approval and Green Card Application
Once the I-526 petition has been approved, the applicant may proceed with filing the green card application.
Step 4: Conditional Green Card Approval
Following approval, the applicant and eligible family members receive conditional green cards, allowing them to live and work in the United States without requiring a separate work visa.
Step 5: Removal of Conditions
Approximately two years later, Form I-829 must be filed to remove the conditions on permanent residence. This filing must show that:
- 10 full-time jobs for U.S. workers were created, or
- The investment resulted in measurable economic benefits
If the petition is approved, permanent green cards are issued. If not, conditional status may be revoked.
The $800,000 investment is typically returned after the I-829 petition has been approved.

Minimum investment thresholds include:
- $800,000 USD for projects located in a Targeted Employment Area (TEA)
- $1,050,000 USD for projects outside a TEA
Many investors choose the Regional Center model because it offers a more passive investment structure.
Understanding Targeted Employment Areas (TEAs)
A Targeted Employment Area may include:
- Rural locations outside major metropolitan regions
- Areas experiencing unemployment rates at least 150% of the national average
Even in a TEA, the investment must still create 10 full-time jobs within two years.
EB-5 Visa Processing Time
The EB-5 visa processing time depends on several factors, including USCIS workloads, country-specific demand, and the complexity of the application.
A general timeline includes:
- Filing and review of Form I-526
- Green card application processing
- A two-year conditional residence period
- Filing and adjudication of Form I-829
In most cases, the full EB-5 green card process takes approximately 2–5 years.
