Individuals already inside Canada who fear persecution or who would be in danger if they returned to their home country may apply for asylum as a convention refugee in Canada.

Some of the dangers they may face include:

• Torture
• risk to their life
• risk of cruel and unusual treatment or punishment

In the event that an individual wishes to apply for asylum they must be prepared to file a Basis of Claim (BOC) with the government and be prepared to discuss at the Refugee Board the dangers to them in their home country, why they do not have an internal flight alternative within that country to see safety, as well as why they cannot seek the protection of the police.

In many cases there is already a well documented pattern of danger to individuals from particular groups based on ethnicity, gender, religion, sexual orientation and other factors, but specific evidence is always necessary to prove the danger in returning to the home country.
