Initial Investment

Filing Form I-526
The next step involves filing Form I-526 with U.S. Citizenship and Immigration Services (USCIS). This petition must demonstrate:

  • An investment of at least $800,000 USD in a qualifying project
  • A lawful source of investment funds
  • Compliance with all EB-5 program requirements

Green Card Application
Once USCIS approves Form I-526, the applicant may proceed with the green card application process.

Conditional Residence
Following approval, the investor and eligible family members receive conditional permanent resident status. This allows them to live and work in the United States without obtaining separate work authorization.

Filing Form I-829
Approximately two years after conditional residence is granted, Form I-829 must be filed to remove the conditions on permanent residence. The petition must show that:

  • At least 10 full-time jobs for U.S. workers were created, or
  • The investment produced qualifying economic benefits

If approved, the conditions are removed. If not, the green cards may be withdrawn.

The investment of $800,000 USD is generally returned after the I-829 petition has been approved, subject to the terms of the project.

A Targeted Employment Area may include:

  • Rural locations outside major metropolitan regions
  • Areas where unemployment rates are at least 150% of the national average

Even in these designated areas, the project must still create 10 full-time jobs within two years.
