A Labour Market Impact Assessment (LMIA) is required for a foreign worker to be hired by a Canadian company that has demonstrated no qualified Canadian citizens or permanent residents exist in the labour market.<\/p>\n
In order to obtain an LMIA an employer must advertise according to the strict requirements of ESDC and interview any qualified candidates. If no such qualified candidates are available then the employer must justify in an application to Employment and Social Development Canada (ESDC) the steps they have taken and why the foreign candidate is the only suitable candidate.<\/p>\n
In such an application it is important to demonstrate through the application that not only is there a labour need in the organization but that there is no suitable candidate in the Canadian labour market. This can be proven through a professionally prepared application demonstrating that the salary offered was sufficient and the position was advertised correctly according to ESDC guidelines.<\/p>\n
