What to Expect During the EB-5 Green Card Process

Although every application is unique, the process generally follows a series of established steps.

Selecting and Funding a Qualifying Investment
The first stage involves choosing a qualifying Regional Center project or direct investment and transferring the required investment funds along with applicable administrative fees.

Filing Form I-526
The investor then files Form I-526 with U.S. Citizenship and Immigration Services (USCIS). This petition must establish:

  • An investment of at least $800,000 USD in a qualifying project
  • That the investment funds originated from lawful sources
  • Compliance with current EB-5 program requirements

Applying for Conditional Residence
After Form I-526 is approved, the applicant proceeds with the green card application. Once approved, the investor and qualifying family members receive conditional permanent resident status that allows them to live and work throughout the United States.

Removing the Conditions
Approximately two years later, Form I-829 must be filed. This petition must demonstrate that:

  • The investment created at least 10 full-time jobs for U.S. workers, or
  • The investment resulted in qualifying economic benefits for the project area

If USCIS determines the requirements have been satisfied, the conditions on permanent residence are removed. If they are not, conditional resident status may be withdrawn.

After Form I-829 has been approved, the original $800,000 investment is generally returned according to the terms established by the investment project.

EB-5 Visa Processing Time

The EB-5 visa processing time can differ from one applicant to another depending on processing backlogs, country-specific demand, and individual case circumstances.

In general, investors can expect the process to include:

  • Filing and adjudication of Form I-526
  • Green card application processing
  • Two years of conditional permanent residence
  • Filing and review of Form I-829

Although individual timelines vary, the overall EB-5 green card process generally takes 2–5 years.

  • $1,050,000 USD for projects located outside a TEA

 

Understanding Targeted Employment Areas

Targeted Employment Areas help encourage investment in communities that may benefit from additional economic activity.

A TEA may be:

  • A rural area outside major metropolitan regions
  • An area with unemployment rates of at least 150% of the national average

Regardless of where the investment is made, the project must still create 10 full-time jobs within two years.

 

Typical Timeline

While every application progresses at its own pace, most investors move through the following sequence:

  • Select a qualifying investment
  • Transfer investment funds
  • File Form I-526
  • Receive USCIS approval
  • Apply for conditional permanent residence
  • Maintain conditional residence for two years
  • File Form I-829
  • Receive permanent resident status without conditions

Most applicants complete the process within approximately 2–5 years.
