Investment Phase

I-526 Petition Filing
The investor then submits Form I-526 to U.S. Citizenship and Immigration Services (USCIS). This filing must establish that:

  • The applicant invested at least $800,000 USD in a qualifying project
  • The investment funds originated from lawful sources
  • The investment meets all applicable EB-5 requirements

Green Card Application
Following approval of the I-526 petition, the investor may proceed with the green card application process.

Conditional Permanent Residence
Once approved, the investor and qualifying family members receive conditional green cards. This status permits them to live and work anywhere in the United States.

Removal of Conditions
Approximately two years later, Form I-829 must be filed. This petition must show that:

  • At least 10 full-time jobs were created for U.S. workers, or
  • The project generated qualifying economic benefits

If the requirements are satisfied, permanent resident status continues without conditions. If they are not met, the green cards may be withdrawn.

The $800,000 investment is generally returned after the I-829 petition has been approved, subject to the project’s terms and repayment schedule.

What Qualifies as a Targeted Employment Area?

A Targeted Employment Area is generally defined as:

  • A rural area located outside major metropolitan regions, or
  • An area experiencing unemployment rates of at least 150% of the national average

Regardless of where the investment is made, the project must still create 10 full-time jobs within two years.

Although each application is different, the process commonly follows this progression:

  • Transfer of investment funds
  • Filing Form I-526
  • USCIS review and approval
